Short Description

The rule establishes requirements for a program of grants and loans to local governments for remedial action pursuant to RCW 70.105D.070 (3) (a) and (7). The intent of remedial action grants and loans is to encourage and expedite the cleanup of hazardous waste sites and to lessen the impact of the cleanup on ratepayers and taxpayers. The grants and loans are to supplement local government funding for remedial actions.

Abstract Long Description

Ecology is amending chapter 173-322 WAC, Remedial Action Grants & Loans for the following reasons: 1) implement new grant programs, 2) implement an existing loan program, 3) improve the operation of the existing grant programs, and 4) improve the clarity and usability of the rule. Specific changes were made in the following areas: definitions, administration and fiscal controls, oversight of remedial action grants, independent remedial action grants, area-wide ground water remedial action and safe drinking water grants.

Included in the rule changes is language amending eligibility requirements to allow funding for remedial actions performed under CERCLA orders issued prior to the effective date of rule amendments, if the local government submits a grant application within 6 months of the effective date of the rule amendments.

This amendment to Chapter 173-322 WAC becomes effective on April 18, 2005.
