The Washington State Supreme Court issued a decision in March 1997 that affects the Department of Ecology′s water rights permitting process. The court′s 5-4 decision in Hillis v. State Department of Ecology held that certain agency policies regarding water rights decision-making should have been adopted as formal rules. This focus sheet gives some background information, describes the case's four main issues, and how Ecology is reponding to the Hillis decision. |
