Section 312 - Tier Two - Emergency & Hazardous Chemical Inventory Reporting

Under Section 312 of Title III, facilities that store chemicals must provide specific information about the chemicals on site to the State Emergency Response Commission (SERC), Local Emergency Planning Committees (LEPCs), and local fire department.

A facility is required to report for each hazardous substance or product present in quantities equal to or greater than established threshold amounts, unless the substance is excluded under Section 311 (e). Hazardous substances are any substances for which a facility must maintain a MSDS under OSHS's Hazard Communication Standard. The EPA's Consolidated List of Lists is a good reference for reportable thresholds. All Extremely Hazardous Substances (EHS) are include on this list. However, the list does not include all reportable substances. The reporting threshold for products that are not listed is 10,000 pounds at any one time.
