YAKIMA - The Washington Department of Ecology has issued a $30,000 penalty to Jeffrey L. Kinzel for illegally filling in a significant shoreline area along the Wenatchee River near Dryden.
Kinzel has constructed a 205-feet-long rock dike and deposited more than 100 dump-truck loads of fill in an area of the 100-year flood plain without authorization from the state or Chelan County.
"The dike and backfilling has narrowed the river's course, which causes stream flows to speed up and threatens flood damage to downstream property owners," explained Gary Graff, a shoreline specialist for Ecology. "Over the years, we've tried to work with Mr. Kinzel to help him comply with state and local regulations, but so far he has chosen not to take advantage of that assistance."
In July, the Department of Ecology served a "notice of correction" to Kinzel advising him to stop any further development along his property's shoreline, including dredging, landfilling, grading, and disturbing habitat and vegetation.
In addition, he was ordered to develop a plan for removing the fill and restoring disturbed areas. He was supposed to submit the plan to Chelan County and Ecology within 30 days of receiving the notice. He also was advised to apply for permits and shoreline management authorizations needed to undertake the restoration project.
Kinzel has 30 days to apply to Ecology for relief from the penalty or appeal the penalty directly to the Shoreline Hearings Board.
