Chapter 173-160 WAC - Rule Adopted on December 19, 2008

On December 19, 2008, Ecology adopted amendments to Chapter 173-160 WAC: Minimum Standards for Construction and Maintenance of Wells. These changes go into effect January 19, 2009. 

Ecology worked on the changes for two years with the Technical Advisory Group (TAG), which was created by the Legislature. The TAG is chaired by Ecology and composed of drillers, health officials, an engineer, a Hydrogeologist, and Ecology staff. In this rulemaking.  Ecology made typographical and technical corrections, and added new sections to the regulation. The typographical and technical corrections were made to clarify the existing rule to make it easier to understand and use. The new sections contain language limiting the use of certain drilling materials to prevent contamination of ground water. Ecology is requiring that these materials be certified by the National Sanitation Foundation and the American National Standards Institute.

Ecology issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act.  A Small Business Economic Impact Statement was not prepared as this rule amendment is exempt under RCW 18.85.020(2) and RCW 18.85.030.

Adoption date

The rule was adopted on December 19, 2008. These changes go into effect January 19, 2009.
