Pollution Prevention Plans and Fees

The following information is based on the Hazardous Waste Reduction Act Focus Sheet, Department of Ecology Publication # F-WRRLC-91-111, Revised 3/96.


The Hazardous Waste Reduction Act

The Legislature passed the Hazardous Waste Reduction Act in 1990. Chapter 70.95C of the Revised Code of Washington (RCW) establishes state policies and goals that encourage the reduction of hazardous substance use and the generation of hazardous waste. The law achieves its goals by requiring certain hazardous waste generators and hazardous substance users to prepare plans for voluntarily reducing hazardous substance use and hazardous waste generation.

In addition, the act allows Ecology to collect two fees.

Pollution Prevention Plans and Fees

Pollution Prevention Plans are required from

  • businesses that generate more than 2,640 pounds of hazardous waste a year, or

  • businesses required to report their toxic chemical releases under the 1986 Superfund Amendments and Reauthorization Act (SARA) Title III, Section 313.

Planners are required to develop performance goals and report annually to Ecology on their progress.

  • Facilities submitting Pollution Prevention Plans pay a variable amount Planning Fee.

Ecology has developed a planning guide entitled Pollution Prevention Planning Guidance Manual, Publication #91-2 Revised, September 1996, available from the regional offices listed below.

Pollution Prevention Plan regulations are found in Chapter 173-307 of the Washington Administrative Code (referred to as the WAC).

Hazardous Waste Education Fees

  • All hazardous waste generators pay the annual Hazardous Waste Education Fee of $35.

Hazardous Waste Fee regulations are found in Chapter 173-305 of the Washington Administrative Code (referred to as the WAC).
