State-only Dangerous Waste Transportation Requirements

State-only dangerous waste that is not regulated as a Federal Hazardous Waste under 40 CFR Part 261 or as a hazardous material under 49 CFR must fulfill the following requirements before transport:

  1. Package in a nonleaking container or in a package that is equivalent to the manufacturing and testing specifications for packagings and containers in 49 CFR Parts 173, 178 and 179.
  2. Mark each package containing one thousand gallons or less with the following:
  3. "Washington State Dangerous Waste-State law prohibits improper disposal. If found, contact the nearest police or public safety authority, and the Washington State Department of Ecology."

    The generator's name and address and manifest number must also be included, as well as the state shipping description as described in WAC 173-303-180(7).

The use of any other markings for a state-only dangerous waste is prohibited.

The packaging requirements are similar as for federally-regulated hazardous waste. The containers must be marked with the generators' name, address, manifest number (if applicable), and one of the statements below:

  • Material not regulated by DOT, (WA state dangerous waste only, Toxic)

  • Material not regulated by DOT, (WA state dangerous waste only, Toxic, Persistent)

  • Material not regulated by DOT, (WA state dangerous waste only, Solid Corrosive)

State-only dangerous wastes that are not Federally regulated Hazardous Wastes, but that are regulated as hazardous materials by the DOT, must also follow the DOT regulations for labeling, marking, and packaging.
