Coastal Zone Management Program Updates

NOTICE OF ROUTINE PROGRAM CHANGE (RPC) to WASHINGTON’S COASTAL ZONE MANAGEMENT PROGRAM

CLEAN WATER ACT

Section 307(f) of the federal Coastal Zone Management Act (CZMA) states that requirements established by a state or local government pursuant to the federal Clean Water Act “shall be incorporated” into any program developed under the CZMA.

Program Change Guidance issued in July 1996 by the National Oceanic and Atmospheric Administration’s (NOAA) Office of Ocean and Coastal Resource Management (since renamed the Office for Coastal Management) calls for states with Coastal Zone Management programs to issue a notice informing the public, interested parties, federal, state, and tribal governments that provisions of the states’ Clean Water Acts (In Washington - the “Water Pollution Control Act Chapter 90.48 RCW) and its implementing regulations (contained in the Washington Administrative Code - WAC) have been incorporated into their coastal programs.

The Department of Ecology, as administrator of the Washington Coastal Zone Management Program (WCZMP), last  issued a public notice in November, 2015 stating that all provisions of the State’s Water Pollution Control Act and implementing regulations were incorporated into the WCZMP. The Water Pollution Control Act Regulations (WAC 173-201A) were amended in August, 2016, with an effective date of September 1, 2016. Ecology is providing notice that the changes have been incorporated into the WCZMP.

See the above background material for a description of NOAA requirements.  Similar to the State Water Pollution Control Act, the State Clean Air Act’s provisions are incorporated into Washington’s Coastal Zone Management Program upon issuance of a public notice.  In November, 2015, Ecology issued a public notice announcing that the provisions below had been incorporated into the Program:

SHORELINE MANAGEMENT ACT

Ecology last submitted changes to the SMA and associated WACs as changes to the WCZMP in 2000, which NOAA approved in 2001. This current submittal contains all changes to the SMA and WACs since 2001. The majority of the WAC changes were the result of changes to the SMA that directed Ecology to ensure consistency between the law and its implementing regulations. Ecology has determined that these legislative and administrative updates are RPCs to the WCZMP rather than Amendments because they do not constitute a substantial change to any enforceable policies or authorities of the WCZMP.
