Bonney Lake Shoreline Master Program: Limited Amendment

On August 11, 2015, the Department of Ecology approved Bonney Lake’s Limited Amendment to the Shoreline Master Program (SMP). Per RCW 90.58.090, the effective date of Bonney Lake’s limited SMP amendment is August 25, 2015, 14 days after Ecology provided notice to the city that their shoreline program was approved.

Ecology used mail and email to notify interested parties of the public comment period. We received a total of one comment letter.  Comments focused on cultural resources which did not pertain to the limited amendment. On July 27, 2015 Ecology sent a summary of comments to the city for their response. The public comments and city’s responses have been incorporated into a responsiveness summary that is available below.

This amendment will incorporate three recent changes to the city’s Critical Areas Ordinance into the SMP: 

  1. Updated wetland regulations which address Ecology’s 2014 changes to the Washington State Wetland Rating System.
  2. Revised floodplain code for compliance with the National Floodplain Insurance Program and State Floodplain Regulations.
  3. Revised definition of fish and wildlife habitat conservation areas consistent with RCW 36.70A.030(5) which exempts artificial waters maintained by port districts or irrigation districts or companies such as irrigation delivery systems, irrigation infrastructure, irrigation canals, or drainage ditches.

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in The Enumclaw Courier-Herald legal ads on September 2, 2015.
