Clark County Shoreline Master Program: Limited Amendment

On May 9, 2016, the Department of Ecology approved Clark County’s Shoreline Master Program (SMP) limited amendment. Per RCW 90.58.090, the effective date of Clark County’s shoreline program amendment is May 25, 2016, 14 days after Ecology provided notice to Clark County that their shoreline program amendments were approved.

The amendments:

  • add Carty Lake to the list of SMP regulated waterbodies;
  • add language addressing existing residential structures;
  • revise language addressing maintenance and repair;
  • correct numerous scriveners’ errors; and
  • incorporate recent critical area ordinance changes, adopted by Ordinance No. 2014-12-05 including the 2014 wetlands rating system, into the SMP

Ecology used mail and email to notify interested parties of the public comment period held April 6 through April 21, 2016. We received no comments.

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in the Reflector legal ads on May 23, 2016.
