Orting Shoreline Master Program: Limited Amendment

On July 15, 2013, the Department of Ecology approved Orting’s Shoreline Master Program (SMP) limited amendment. Per RCW 90.58.090, the effective date of Orting’s shoreline program limited amendment is July 29, 2013, 14 days after Ecology provided notice to Orting that their shoreline program limited amendment was approved.

The limited amendment revises the existing shoreline program, which was comprehensively updated in 2008. The proposed amendment will accommodate the landward relocation, or setback, of existing levees, dikes and revetments consistent with an adopted flood hazard management plan.

On June 26, 2013, the Department of Ecology provided the City of Orting with required and recommended changes to the city’s proposed limited amendment submitted to Ecology in April 2013. The changes were based on Ecology’s review of whether or not the proposed limited amendment complies with state laws and rules, and a public comment period held April 29 – May 29, 2013.

Ecology used mail and email to notify those who had expressed prior interest and also issued a news release and legal ad to encourage public participation and comment. Ecology received one comment letter from a state agency. Comments focused on provisions in the Archaeological and Historic Resources section of the master program. On May 29, 2013, Ecology sent a summary of comments to the city for their response. The public comments and city’s responses have been incorporated into Attachment A: Findings and Conclusions (below).

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in the News Tribune legal ads on July 26, 2013.
