Snohomish County Shoreline Master Program: Limited Amendment

On May 12, 2014, the Department of Ecology approved Snohomish County’s Shoreline Master Program (SMP) limited amendment. Per RCW 90.58.090, the effective date of Snohomish County’s shoreline program amendment is May 26, 2014, 14 days after Ecology provided notice to Snohomish County that their shoreline program amendment was approved.

This SMP amendment addresses changes to commercial aquaculture policies and regulations in response to a negotiated settlement agreement under Central Puget Sound Growth Management Hearings Board case number 12-3-0009. The parties to this agreement include The Pacific Coast Shellfish Growers Association, Snohomish County, and the Department of Ecology. This approval puts the final stamp on a process to improve aquaculture management in Snohomish County.

Ecology used mail and email to notify interested parties of the public comment period. We received a total of fourteen individual comments from two organizations. Comments focused on a shoreline use conflicts, habitat stewardship, defining uses in the aquatic shoreline environment and introduction of non-native aquatic organisms. On March 28, 2014, Ecology sent a summary of comments to Snohomish County for their response. The public comments and county’s responses have been incorporated into a Responsiveness Summary (Below).

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in the Everett Herald legal ads on May 27, 2014.
