Federal Way Shoreline Master Program: Comprehensive Update
On November 18, 2011, the Department of Ecology approved
Federal Way’s Shoreline Master Program (SMP) comprehensive
update. The comprehensive update revises the existing shoreline
program, including the goals, policies, regulations, shoreline
environment designations, and administrative procedures and
definitions. Federal Way has 4.8 miles of Puget Sound shoreline
and 12 miles of shoreline along Steele, North and Kilarney
lakes.
The updated program will promote shoreline habitat protection
while also recognizing the continuation of established
residential development on the City's shorelines. The City’s
proposed program also addresses the need for updated shoreline
policies and regulations which reflect the current level of
environmental protection and land use management provided by
City comprehensive plan elements and other applicable City codes.
On August 30, 2011, Ecology conditionally approved Federal
Way’s proposed SMP comprehensive update pending certain changes
to bring the SMP into compliance with the Shoreline Management
Act (Chapter 90.58 RCW) and the Shoreline Master Program
Guidelines (WAC 173-26, Part III). On November 16, the City
formally accepted Ecology’s changes.
Ecology’s final approval brings to closure a significant City
effort that increases protection and restoration of habitat and
water quality, provides more certainty for development, and
improves public access and recreational opportunities.

Per RCW 90.58.090, the effective date of
Federal Way’s shoreline program is December 2, 2011,
fourteen days after Ecology provided notice to Federal Way that their shoreline program was approved.

Appeals
- Per RCW 90.58.190(2) and RCW 36.70A.290, an interested
party may file an appeal with the
Growth Management Hearings
Board within 60 days of the publication date of
Ecology’s written notice of final action.
- Ecology plans to publish the notice of final action in
the Federal Way Mirror legal ads on November 30, 2011.
