Seattle Shoreline Master Program: Limited Amendment

On February 4, 2013, Ecology approved the City of Seattle’s limited amendment of its Shoreline Master Program (SMP). Per RCW 90.58.090, the effective date of Seattle’s limited SMP amendment is February 18, 2013, 14 days after Ecology provided notice to the City that their shoreline program was approved.

The amendment revises the existing shoreline program to allow utility service uses such as underground sewage and stormwater storage tanks. These uses will be allowed as conditional uses in the Conservancy Recreation (CR) environment. The amendment is necessary to allow the City to comply with updated requirements to their National Pollution Discharge Elimination System (NPDES) permit.

Ecology’s approval is based on a comparison of the City’s proposal against state laws and regulations, and a public comment period held December 7, 2012 through January 7, 2013. Ecology used mail and email to notify interested parties of the opportunity to provide comments related to the proposal. At the conclusion of the 30-day comment period, Ecology had not received any comments on the City’s proposal.

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in The Daily Journal of Commerce legal ads on February 13, 2013.
