Westport Shoreline Master Program: Limited Amendment

On June 26, 2013, the Department of Ecology approved the City of Westport’s Shoreline Master Program (SMP) limited amendment. The limited amendment is to transfer the authority for shoreline permitting decisions from the planning commission and city council to a professional Land Use Hearing Examiner.

Ecology held a public comment period from March 21 – April 19, 2013. Ecology also used mail and email to notify those who had expressed prior interest. We received a total of 14 individual comments from 3 individual citizens. Comments focused on whether the Hearing Examiner approach would provide equitable treatment, be accountable to citizens of the City, and not add costs in administration of duties.

On May 1, 2013, Ecology sent a summary of comments to the city for their response. The public comments and city’s responses have been incorporated into Attachment D: Responsiveness Summary (see below).

Per RCW 90.58.090, the effective date of the City of Westport’s shoreline program is July 10, 2013, 14 days after Ecology provided notice to the City of Westport that their shoreline program was approved.

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of Ecology’s written notice of final action.
  • Ecology plans to publish the notice of final action in the Daily World legal ads on July 16, 2013.
