How do I Apply for a Beneficial Use Determination (BUD)?Click here to access the form necessary for applying for a BUD. Ecology currently has no system in place for on-line submittal of applications and supporting documentation. Please read the application carefully to ensure you understand what information Ecology needs in order to consider your application. Attachments may be submitted on pages no larger than 11" x 17". If you have difficulty downloading forms or need hard-copies mailed to you, please contact the beneficial use determination coordinator to request necessary forms or call (360) 407-6000.A State Environmental Policy Act (SEPA) checklist must also be submitted. Except for proposals sponsored by a government agency, the Department of Ecology will be lead in SEPA determinations. Click here to download the checklist. Once an application and SEPA checklist are submitted to Ecology, an initial review will be conducted and the applicant will be notified either that more information is necessary to complete the application or notice will be given to the applicant that Ecology has determined the application to be complete and a review and comment period will begin. Once determined to be complete, the department will have 90 days to render a decision unless the applicant and Ecology agree to an extension. When an application has been determined to be complete by the department and the comment period has begun, no additional information or changes will be considered. In the event the applicant chooses to make additional submittals or changes, health departments and interested parties will be notified that the application has been withdrawn and the review process will start over.
