Rule Development - Children's Safe Products Reporting Rule

The Department of Ecology has adopted amendments to the Children's Safe Products - Reporting Rule, Chapter 173-334 WAC. Under this chapter, manufacturers of children's products must report on the presence of certain chemicals in children's products.

What is the purpose of this rulemaking?

In October 2013 Ecology adopted amendments to the reporting rule in response to a petition to add tris(1,3-dichloro-2-propyl)phosphate (TDCPP) (CAS # 13674-87-8) to the list of CHCCs, and and to remove n-butanol (CAS # 71-36-3) from the reporting list of chemicals.

Timeline of Rulemaking Activity

July 24, 2013 Proposed rule text released. Beginning of public comment period.
August 27, 2013, 6pm Public hearing. Location: Washington State Department of Ecology Headquarters, 300 Desmond Drive, Lacey WA.
September 6, 2013 End of public comment period.
October 22, 2013 Adopt, file, and publish the rule and send out Rule Adoption Notice.
November 22, 2013 Rule goes into effect (31 days after it has been adopted and filed.)
February 28, 2015 Projected due date for first reports that must include tris(1,3-dichloro-2-propyl)phosphate (TDCPP) (CAS # 13674-87-8) under the revised rule.

Ecology informed the public about this rule process to meet public involvement requirements of the Administrative Procedures Act (Chapter 34.05 RCW) in the following ways:
  • Web Site. Ecology will regularly update this rule development page with information on rule activities, including how to comment on the proposed rule.
  • Rulemaking documents. Rulemaking documents are available on Ecology's web site.
  • Email Notices (ListServ). Ecology created an electronic mailing list to email information and notices to persons interested in this process. Ecology encourages interested persons to sign up.
