Rules Under Development
Rules listed on this page are rules the Waste 2 Resources Program is
currently working on through the rule development process. These rules
are all at various stages of the rule-making process (Chapter 34.05
RCW). At a minimum, we have either filed a CR-101 form (announcing the programs
intentions and inviting participation in the rule-making process) or began
the pilot rule-making process.

particular rule you are interested in, including how to comment on the
rule and participate in the process.
- Children’s Safe Product - Reporting Rule
Ecology is using the pilot rule-making process to develop this rule. This allows us to use a pilot
project to test the rule language with manufacturers that will be regulated under the rule prior to
adoption. Ecology is seeking volunteers from small to large manufacturers to help pilot test this
rule. The purpose of this rule is to: Establish how manufactures of children’s products will meet
the reporting requirements created by the Children’s Safe Product Act (CSPA), establish procedures
Ecology will use to review and periodically update the list of chemicals that manufacturers must
report on, and clarify the enforcement processes Ecology will use for failure to report.
There are two phases to this effort: 1) advisory group and 2) pilot rule. We are currently seeking
volunteers for the pilot project phase.
- Criteria for Municipal Solid Waste Landfills, WAC 173-351 This
rule will adopt new federal regulations and allow for issuance of Research, Development and
Demonstration (RD&D) permits; eliminate equivalent and arid liner designs; and extend
greater flexibility for alternate liner designs consistent with federal regulations.
