Overview of Rule Amendment

In November 2007 the Department of Ecology (Ecology) began the process to write a new rule, Chapter 173-345 WAC, Recyclable Materials - Transporter and Facility Requirements. The purpose of this regulation is to regulate transporters of recyclable materials and recycling facilities. This rule will implement SB 5788, passed by the 2005 legislature, under the authority of Chapter 70.95.400-430 RCW.

This rule focuses on:
  • Registration requirements for transporters of recyclable materials
  • Notification requirements for recycling facilities
  • Penalties for non-compliance with requirements of this rule
The revisions impact all transporters of recycling materials and recycling facilities in the state.

Public Involvement

Ecology developed several ways to inform the public about this rule amendment to meet public involvement requirements in the Administrative Procedure Act (Chapter 34.05 RCW):
  1. Web Site. Ecology updated this rule development web page with information on rule activities, including how the public could comment on the proposed rule.
  2. Email Notices (ListServ). Ecology created the WAC 173-345 WAC, Recycling: Transporter Registration and Facility Notification electronic mailing list (ListServ) to email information and notices to persons interested in the proposed rule amendments. Ecology encouraged interested persons, including those involved with recycling facilities and transporters and the public to sign up.
  3. Informal Public Workshops. Ecology held 3 workshops in March 2008 in Spokane, Bellevue, and Lacey and received about 100 comments. Interested persons asked questions about the rule and commented on the preliminary rule draft. The public was invited to these workshops.
  4. Public Hearings. Ecology conducted one public hearing in Lacey, WA, where formal comments on this rule were submitted.
