Proposed Amendments to the Sediment Management Standards

On August 15, 2012, the Department of Ecology (Ecology) filed proposed amendments to Chapter 173-204 WAC, Sediment Management Standards (SMS). The proposed rule amendments and supporting environmental and economic analyses are available for public review and comment. Public hearings were held in five locations throughout the state between September 26 and October 4, 2012.

The Department of Ecology has decided to extend the public comment period.  The current public comment period started Aug. 15, 2012, and was slated to end Oct. 15, 2012.  In response to requests for more time to comment Ecology is extending the public comment period by two weeks to Oct. 29, 2012.  Ecology will review, consider and respond to all comments. The proposed rule revisions may be modified based on public comments. Ecology expects to adopt the rule in late 2012 or early 2013.

Public Hearing Schedule

Ecology will hold six public hearings on the proposed amendments to the SMS rule.   Ecology will be at each hearing location 30 minutes before the start of the hearing for an Open House. Following the Open House, there will be a short presentation from Ecology followed by a Question and Answer session. Testimony will start at the conclusion of the Question & Answer session.

Ecology’s Response to Your Comments

All of the comments we receive will become part of the official record. We will publish responses to comments in a document called a Concise Explanatory Statement (CES). The CES is required by the Administrative Procedures Act (RCW 34.05) and will be available after the rule is adopted. In the CES your name will be listed with a reference to where, in the document, Ecology responded to your comments.

Expected Adoption Date

Ecology expects to adopt this rule no earlier than December 14, 2012.
