Chapter 173-360 WAC

Underground Storage Tank Regulations

Public Involvement

On July 10, 2017, the Department of Ecology (Ecology) submitted a preliminary draft of new Chapter 173-360A WAC, Underground Storage Tank (UST) regulations, for informal stakeholder review.  The new chapter would modify and replace existing Chapter 173-360 WAC.  The preliminary draft is available for review until August 18, 2017.  Ecology will consider your comments when developing the formal proposal.  Ecology plans to submit the formal proposal for public review in December 2017.

Identification of changes from current rule


To identify proposed changes in the preliminary draft rule, we have included the following:
  • Overview of changes document.

  • This document provides a summary of the proposed changes in the preliminary draft rule, and identifies which changes were made to comply with state program approval (SPA) requirements in 40 C.F.R. Part 281 or to be consistent with federal rule requirements in 40 C.F.R. Part 280.

  • Footnotes throughout the text of the rule.

  • The footnotes document each change or clarification of the rule, and how certain provisions may differ from the comparable provisions in the federal rule.

  • Rule crosswalk at the beginning of each Part of the rule.

  • The crosswalk outlines where each of the provisions is addressed in the current state rule and in the federal rule.

Except for Part 10 (financial responsibility), proposed changes are not tracked using strikeouts and underlines.  The use of strikeouts and underlines in the other Parts of the rule is not useful for conducting reviews given the amount of reorganization.

The comment period on the preliminary draft rule ends August 18, 2017.

Next steps


Ecology will consider your comments on the preliminary draft when developing the formal rule proposal.  Ecology plans to submit the formal proposal for public review in December 2017.
