My Application

How do I enter the VCP?

To enter the VCP, you must complete and submit to Ecology a VCP application and Ecology must accept your application.

Who may apply?

Anyone may apply, including:


  • Property owners.
  • Consultants.
  • Attorneys.

However, please note that the applicant (known as the “Customer”) is the only person who may request services and is responsible for paying for those requested services.

If I’m a local government and want to obtain grant funding from Ecology, do I need to apply separately? If so, when and how?

YES.  To obtain grant funding from Ecology for your independent remedial actions, you must apply separately.  You may only apply for and obtain such a grant after cleaning up the whole site and obtaining a No Further Action (NFA) opinion from Ecology.  For additional information about the remedial action grant program and how to apply for a grant, please visit: www.ecy.wa.gov/programs/swfa/grants/rag.html.

When may I apply?

You may apply at any time, including:

  • Before conducting the cleanup.
  • During the performance of the cleanup.
  • After completing the cleanup.

How do I apply?

To apply, you must complete and submit to Ecology a VCP application, which consists of the following two documents:

  • VCP Application Form.
  • VCP Agreement.

Where may I download the forms?

The forms, along with Application Instructions, may be downloaded from the following VCP web page: Just the Forms.  The forms may be downloaded as either:

  • An electronic form (Word), which can be completed electronically, or
  • A hard copy form (PDF), which can be completed by hand.

Who must sign the VCP Agreement?

The Customer must sign the VCP Agreement.  The Customer is the person or organization requesting services from Ecology under the VCP, and is responsible for paying the costs incurred by Ecology to provide those services.  The rights and duties of the Customer are explained in the Agreement.

How do I request an opinion when applying?

To request an opinion when applying to enter the VCP, do the following:

  1. Request an opinion in Part 1 of the Application Form.
  2. Submit the following documents with your application:
  • Independent remedial action plan or report.
  • Terrestrial Ecological Evaluation Exclusion Form (if applicable).
  • If completed cleanup used model remedy, include description in cover letter.

In summary, what must I submit to complete my application?

To complete your VCP application, submit the following documents to Ecology:

  • Agreement (signed by Customer).
  • Application Form (signed).
  • Map(s) of the Site (see Part 2 of the Application Form).

If you are also requesting an opinion when applying, then submit the following additional documents with your VCP application:

  • Independent Remedial Action Plans or Reports (see Part 1 of the Application Form).
  • Terrestrial Ecological Evaluation Exclusion Form (if applicable).
  • If completed cleanup used model remedy, include description in cover letter.

Where should I mail my completed application?

Mail your completed VCP application to the Ecology regional office for the County in which your Site is located.  For contact information, go to the following VCP web page: Contacts.

If I have questions about my application, who should I contact?

If you have any questions about the application process or how to complete the forms, contact the Unit Manager for the region in which your Site is located.  For contact information, go to the following VCP web page: Contacts.

Ecology’s Response

When should I expect an initial response from Ecology?

You should expect an initial response usually within 10 working days of Ecology receiving your VCP application.  At that time, we will acknowledge receipt of your application and inform you whether your application is complete.  If your application is complete, we may also inform you of our decision at that time.

How will Ecology notify me of its decision?

Ecology will notify you of its decision by letter or e-mail.

If Ecology accepts my application, what will Ecology do next?

If Ecology accepts your application, then Ecology will notify you of the decision.  In that notice, Ecology will do the following:

  • Enclose a copy of the completed, signed VCP Agreement for the project. Ecology will keep the original.
  • Identify the Site.
  • Assign a unique number to the VCP project.
  • Assign a Site Manager to the VCP project. If one is not currently available, Ecology will provide a temporary point of contact.
  • Explain how we will manage the VCP project.

What is the effective date of the VCP Agreement?

The effective date of the VCP Agreement is the date Ecology signs the Agreement.

May Ecology reject my application?

YES.  Ecology may reject your application.  If we reject your application, then we will explain why in the written notice.

Why may Ecology reject my application?

If Ecology rejects your application, it is most likely for one of the following reasons:

  • There is no Site that needed cleanup under the state cleanup law.
  • Ecology is conducting the cleanup of the Site.
  • Ecology is supervising the cleanup of the Site under an order or decree.
  • Ecology has decided to supervise the cleanup of the Site and initiate discussions for an order or decree.
  • Ecology has decided the site is too complex to be managed under the VCP.
  • Your VCP project is limited and does not merit Ecology review at this time.
  • Your VCP project conflicts with another on-going VCP project at the same Site.
  • You are delinquent in paying for services Ecology provided for another VCP project.
  • You are not requesting a written opinion or technical assistance at this time.
