Phase I and Phase II Permit Modification

When the appeals process for the NPDES Phase I and Phase II stormwater permits issued on January 17, 2007 was concluded, Ecology modified the municipal stormwater permits to address the settlement agreements and the Pollution Control Hearings Board (PCHB) orders as they apply to each permit. More information on the appeals to the permit can be found on our Permit Appeals webpage.

Ecology held a public review and comment period on the proposed permit modifications from March 18, 2009 until May 1, 2009. Ecology received the comments listed in the tables below. After considering the comments, Ecology issued the final permit modifications on June 17, 2009. The effective date for the permit modifications was July 17, 2009.

Appeal of Modified Phase I and WWA Phase II Permits

Ecology received one appeal of the modified Phase I and Western Washington Phase II permits. The modified permits that became effective on July 17, 2009 remain in effect. All of the deadlines in the modified permits are in effect. Please continue to check this page for updates related to the appeal.
