
The following letters have been sent by Ecology’s Regional Offices to notify water right holders that their water rights have been accepted into the Trust Water Rights Program. These notices are only for water entering the Trust Water Rights Program as the result of donations.
In 2009 legislation was passed authorizing Ecology to use this website instead of newspapers for public notice for two types of trust water rights, donations and short term leases. The acceptance letters are posted on this webpage to meet the public notice requirement in RCW 90.42.040 (5) (c). “For a trust water right donation described in RCW 90.42.080 (1)(b), or for a trust water right lease described in RCW 90.24.080(8) that does not exceed five years, the department may post equivalent information on its web site to meet the notice requirements…”
A link to those notices is below. The public notice dates below, identify the date the notice is posted, and the date the notice will have met the required two week period. The donation documents will continue to be posted for 30 additional days to accept comments. A link to the comment form for each regional office is provided below. Please follow the directions on the form and submit. Your comments will be received and evaluated by a regional office staff member.
If you plan to appeal a Trust Water Right Donation you must follow the instructions that are provided in the acceptance letter. A link to the acceptance letter is provided below.
Administrative orders and penalty notices issued by Ecology can be appealed to the Washington Pollution Control Hearing Board. For more information read "Your Right to Be Heard"
